1. Acceptance of Terms

By accessing or using the InstaBang website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you are not authorized to use the Service. The Service is intended for adults aged 18 years or older. By using the Service, you represent and warrant that you are at least 18 years of age.

These Terms constitute a legally binding agreement between you and InstaBang. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service after any modification indicates your acceptance of the modified Terms.

2. Description of Services

InstaBang provides a digital platform designed to facilitate connections between consenting adults for the purposes of online dating, communication, and arranging local meetups. Our services include, but are not limited to:

InstaBang acts solely as a venue for introductions. We are not a party to any agreements or interactions between users. We do not guarantee the identity, background, or intentions of any user. You are solely responsible for your interactions with other users.

3. User Requirements & Conduct

As a condition of your use of the Service, you agree to comply with all applicable laws and regulations and to not engage in any prohibited conduct, including but not limited to:

• Providing false, inaccurate, or misleading information in your profile.
• Harassing, threatening, or intimidating any other user.
• Using the Service for any unlawful purpose, including prostitution, solicitation, or trafficking.
• Posting or transmitting any content that is defamatory, obscene, pornographic, abusive, or invasive of another's privacy.
• Impersonating any person or entity, or falsely stating your affiliation with a person or entity.
• Attempting to gain unauthorized access to the Service, other user accounts, or computer systems.
• Using any automated system, including bots, scrapers, or spiders, to access the Service for any purpose.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including removing offending content, suspending or terminating the user's account, and reporting them to law enforcement authorities.

4. Intellectual Property

All content, features, and functionality available on the Service, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the design, selection, and arrangement thereof, are the exclusive property of InstaBang, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of our software.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INSTABANG, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS.
• ANY CONTENT OBTAINED FROM THE SERVICE.
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF INSTABANG EXCEED THE AMOUNT YOU HAVE PAID TO INSTABANG IN THE PAST SIX MONTHS, OR ONE HUNDRED U.S. DOLLARS (USD $100.00), WHICHEVER IS GREATER. THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS.

6. Changes to Terms

We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page periodically so you are aware of any changes, as they are binding on you.

We will endeavor to provide notice of material changes via the Service or by email, but such notice is not guaranteed. The "Last Updated" date at the top of this page will indicate the latest revision.

7. Governing Law & Dispute Resolution

These Terms and any action related thereto will be governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Delaware before one arbitrator.

The arbitration shall be administered by the American Arbitration Association ("AAA") pursuant to its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
